Historia del CNTV

El Consejo Nacional de Televisión es el organismo que debe velar por el correcto funcionamiento de la televisión chilena a través de políticas institucionales que tiendan a orientar, estimular y regular la actividad de los actores involucrados en el fenómeno televisivo, en sintonía con los cambios tecnológicos y socio culturales, en un contexto de creciente internacionalización.

The National Television Council is the institution that must enforce the correct functioning of Chilean television services through institutional policies that aim to guide, stimulate and regulate the activity of the stakeholders involved in the television industry,  in harmony with the technological and socio-cultural changes in a context of growing internationalization.

Naturaleza Jurídica y Misión

El Consejo Nacional de Televisión es un órgano constitucional autónomo. Fue creado y configurado por la Constitución en sus elementos esenciales y su misión es velar por el correcto funcionamiento de los servicios de televisión.

Institución autónoma de rango constitucional con personalidad jurídica y patrimonio propio, y se relaciona con el Presidente de la República por intermedio del Ministerio Secretaría General de Gobierno.

En su carácter de organismo autónomo, el Consejo no depende de autoridad alguna de Gobierno y se relaciona con el Presidente de la República a través del Ministerio Secretaría General de Gobierno.

La ley 18.838, de 1989, modificada por la ley 19.131, de 1992 incorporada en la citada ley, señala la composición, organización y demás funciones y atribuciones del Consejo.

La nueva Ley de TV Digital (ley 20.750), promulgada el 22 de mayo de 2014, y publicada en el Diario Oficial el 29 de mayo de 2014, permite la introducción de la televisión digital terrestre.

La norma elegida para Chile en septiembre 2009, conocida técnicamente como ISDB-Tb, incluye nuevas prestaciones, como es la “movilidad” (el receptor de imagen o televisor y también un Notebook o Netbook con un pequeño receptor tipo Pendrive y conector USB pueden ir desplazándose en un vehículo) y la “portabilidad” (la imagen también puede verse en receptores portátiles tipo celular). La recepción gratuita es la  característica general de la oferta de canales de la Televisión Abierta.

En 2017 se dio a conocer el mapa de las 116 frecuencias digitales disponibles en el país.

La implementación total de la TV Digital en el país está planificada para abril de 2024.

Legal Nature and Purpose

The National Television Council is an autonomous organ according to the Chilean Constitution. It was created and set up in its essential elements by the Chilean Constitution and its task is to enforce the right functioning of television services.

The Council is related to the President of the Republic through the Ministry General Secretary of the Government.

The Act N° 18.838 of 1989, modified by the Act N° 19.131 of 1992, sets up the procedure of appointment of its members,  its internal organization, and other functions and powers of the Council. 

The new Digital Television Act (Act N° 20.750), enacted on May 22 of 2014, allows the creation of terrestrial digital television.

The standard chosen by Chile in September 2009, technically known as ISDB-Tb, includes new features, such as mobility and portability. Free reception is the key feature of the service provided by the main Chilean television stations.

Composición y Generación

El Consejo se compone de once miembros. Uno de éstos, su Presidente, es de libre designación del Presidente de la República y permanece en el cargo hasta 30 días después del cese en el cargo del Primer Mandatario que lo nombró.

Los otros diez Consejeros son designados por el Presidente de la República con acuerdo del Senado. Por mandato legal, el Jefe del Estado debe hacer la proposición cuidando que el Consejo quede integrado en forma pluralista. De la misma manera, la ley exige al Presidente del Consejo una idoneidad que garantice el debido pluralismo en el funcionamiento del

organismo.

Los Consejeros deben ser personas de relevantes méritos personales y profesionales, apreciación que corresponde tanto al Presidente de la República como al Senado. Duran ocho años en el cargo y se renuevan por mitades cada cuatro años.

El Consejo tiene un Vicepresidente y un Secretario General, que son elegidos o removidos con el voto conforme de siete Consejeros en ejercicio. El primero subroga al Presidente en caso de ausencia o impedimento de éste y el segundo es el ministro de fe de las actuaciones del Consejo.

Members and Procedure of Appointment

The Council’s Board has eleven members. Out of those, its President is freely appointed by the President of the Republic and remains in office until 30 days after the President who appointed him/her finishes his/her term.

The other ten members (which are called “Board members”) are designated by the President of the Republic with the approval of the Senate. The Law requires that the President of the Republic makes the nomination of the Board members taking into account that the Council must be composed in a pluralistic way. In the same way, the law requires that the President of the Council is suited to guarantee pluralism in the functioning of the organ.

The members of the Council’s Board must be people with relevant achievements personally and professionally which are assessed by both the President of the Republic and the Senate. The position lasts eight years and is renewed by halves every four years.

The Council has a Vice President and a General Secretary that are chosen or removed with the vote of seven Board members. The first one replaces the President in his/her absence and the second one is the certifying officer of the Council.
